All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information we obtain from other sources

We obtain business contact and professional information from third-party providers of prospecting and contact-enrichment services, suppliers of business contact lists (including purchased lists), and referral or business partners.

This information may include your name, email address, telephone number (including a mobile number supplied as a contact detail), employer or business affiliation, and job title or role. We may use information from these sources to identify prospective business contacts and to supplement or update our business contact records.

We use this information for the business development and communication purposes described in How Do We Process Your Information?, subject to the legal bases described in What Legal Bases Do We Rely On To Process Your Personal Information? You do not need to have an account with us for these activities to involve your personal information.

You can contact team@hypercubic.ai about the source of your personal information or to exercise the rights described in What Are Your Privacy Rights?. You do not need an account to make a request.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  • Location Data. We collect approximate location information derived from your IP address. We do not collect precise GPS location.

Google API

Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

2. How Do We Process Your Information?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, support our business-to-business sales and marketing, for security and fraud prevention, and to comply with law. We process the personal information for the following purposes listed below. We may also process your information for other purposes only with your prior explicit consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
  • To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.
  • To support business development and business communications. We use business contact and professional information to identify prospective customers and relevant contacts, maintain and update our contact records, and communicate about our products and services. Marketing communications are subject to applicable law and your marketing preferences.
  • To handle privacy requests and complaints. We process information as necessary to respond to requests and complaints, honor marketing objections and opt-outs, and meet applicable legal obligations.
  • To support internal training and business activities. We use sales-demo recordings only for internal training and business purposes.

3. What Legal Bases Do We Rely On To Process Your Personal Information?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

If you are located in the EU or UK, this section applies to you.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

  • Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent.
  • Legal Obligations. We may process your information where necessary to comply with an applicable legal obligation, including responding to legally binding requests from law enforcement bodies or regulatory agencies and complying with court orders.
  • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.
  • Legitimate Interests. Where permitted by applicable law, we may process business contact and professional information when necessary for our legitimate interests in identifying prospective business customers, maintaining relevant business contact records, and communicating about our products and services, provided those interests are not overridden by your interests, rights, and freedoms. We may also process information where necessary to establish, exercise, or defend legal claims, subject to the same assessment.

Marketing communications. The applicable permissions and legal basis depend on the activity, communication channel, location, and circumstances. Obtaining contact details from a third party does not itself establish consent to marketing. To object to direct marketing or ask about permissions, contact team@hypercubic.ai as described in What Are Your Privacy Rights?.

Optional website analytics and visitor identification require your separate affirmative choice. Website tracking permission does not authorize marketing email or SMS. We do not currently send SMS messages.

If you are located in Canada, this section applies to you.

We may process your information if you have given us specific permission (i.e., express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e., implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way
  • For investigations and fraud detection and prevention
  • For business transactions provided certain conditions are met
  • If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
  • For identifying injured, ill, or deceased persons and communicating with next of kin
  • If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
  • If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
  • If the collection is solely for journalistic, artistic, or literary purposes
  • If the information is publicly available and is specified by the regulations
  • We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments

4. When And With Whom Do We Share Your Personal Information?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

We may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.
  • Service providers acting on our behalf. We may disclose personal information to service providers that help us operate our Services, process payments, analyze service usage, deliver AI features, or manage business communications. These disclosures are subject to applicable contractual and legal requirements and the restrictions described in this Privacy Notice, including those concerning mobile information. Additional information about payment, analytics, and AI providers appears in sections 1, 6, and 7.

5. What Is Our Stance On Third-Party Websites?

In Short: We are not responsible for the safety of any information that you share with third parties that we may link to or who advertise on our Services, but are not affiliated with, our Services.

The Services may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third-party websites. Information collected by those independent third-party websites, services, or applications is governed by their own privacy notices. Our collection and disclosure of your information, including through providers acting on our behalf, remain subject to this Privacy Notice. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Services. You should review the policies of such third parties and contact them directly to respond to your questions.

6. Do We Use Cookies And Other Tracking Technologies?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

Optional website tools are used for analytics and business-visitor identification only after you allow the relevant purpose. Visitor-identification disclosures may be considered a sale or sharing under applicable privacy laws; the controls and details appear below and in Your US Privacy Rights.

You can exercise your applicable privacy rights by submitting a request as described below under section "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?"

On this website, optional tracking is off until you choose to allow it. You can accept all optional tracking, reject optional tracking, or choose separately between Analytics and Visitor identification and marketing. Site delivery, security, and remembering your privacy choices remain available when you reject optional tracking. Use Privacy choices in the footer, or open the privacy settings, to review or change your choices.

Analytics. If allowed, PostHog, Vercel Web Analytics, and Vercel Speed Insights measure website usage, interactions, and performance. Visitor identification and marketing. If allowed, RB2B and the separate cookie-sync/visitor-resolution service at a.usbrowserspeed.com can associate website activity with business-contact profiles for business outreach. The latter endpoint is described in 5x5 Audience Data Cloud documentation. Google Tag Manager loads only when both optional categories are allowed.

Remembering your choice. When browser storage is available, your saved choice is valid for 180 days from the time you save it. An ordinary page visit does not extend this period. The choice applies to this browser on the same website origin; it is not shared across devices, other subdomains, or preview sites. We ask again when the choice expires or the purposes covered by it change. Browser storage does not automatically delete an expired record; we stop relying on it, and it may remain on your device until replaced or cleared. If storage is unavailable or cleared, you may be asked again. The choice-validity period is separate from the lifetimes of other browser storage and the retention of information held by us or our providers.

Browser storage and lifetimes

The PostHog entries below reflect our configured, installed SDK. The RB2B names and lifetimes are documented in its cookie reference; they are not measurements of this account’s live identity network.

Vercel describes Web Analytics as using a request-derived visitor hash without third-party cookies, with the visitor session discarded after 24 hours. That is a description of the visitor-session mechanism, not a promise that every analytics record or first-party storage item is deleted after 24 hours. See Vercel Web Analytics privacy information and Speed Insights privacy information. Browser-storage lifetimes do not establish provider-server retention periods.

Changing or withdrawing a choice. You can turn off either optional category in Privacy choices. Reducing permissions reloads the page to stop the tools for the category you turn off and removes supported first-party identifiers that the control can access. A category you continue to allow may remain active. This control does not recall information already sent, remove cookies held on third-party domains, or delete business-contact profiles already delivered to our team. Contact team@hypercubic.ai about previously collected information and applicable privacy rights.

Global Privacy Control. When we receive a Global Privacy Control signal from your browser or website request, visitor identification and marketing stay off, including when you choose Accept all. Analytics still requires a separate affirmative choice. If the privacy-signal check cannot be completed, visitor identification and marketing remain off for that visit.

Your website tracking choice does not subscribe you to email or SMS marketing and does not itself withdraw an existing subscription or delete contact records. The separate marketing and privacy-request provisions in this Notice also apply.

To decline visitor identification or exercise website sale/sharing choices, use Privacy choices and turn off Visitor identification and marketing or choose Reject optional. A detected Global Privacy Control signal keeps this category off, including when Accept all is selected. These controls stop future optional tracking in this browser; requests about information already collected can be sent to team@hypercubic.ai.

Google Analytics We may share your information with Google Analytics to track and analyze the use of the Services. To opt out of being tracked by Google Analytics across the Services, visit https://tools.google.com/dlpage/gaoptout. For more information on the privacy practices of Google, please visit the Google Privacy & Terms page.

7. Do We Offer Artificial Intelligence-Based Products?

In Short: We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies.

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.

Use of AI Technologies

We provide the AI Products through third-party service providers ("AI Service Providers"), including Anthropic, OpenAI and Google Cloud AI. As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in "WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?" You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.

Business AI accounts and model training. We use enterprise or team accounts for OpenAI and Anthropic. These providers process information we submit to deliver their services. Their commercial offerings do not use customer content to train their models by default, subject to the applicable terms and any explicit training opt-in or feedback submission.

Our AI Products

Our AI Products are designed for the following functions:

  • AI applications

How We Process Your Data Using AI

Our AI service providers process the inputs and outputs needed to deliver the AI features you use. The commercial-account training defaults described above are separate from provider processing and retention. The security considerations in How Do We Keep Your Information Safe? also apply.

8. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Hypercubic is based in the United States. Information may be stored and processed by us and the recipients described in When And With Whom Do We Share Your Personal Information?, including in countries other than your own. Our PostHog Landing Page analytics project is hosted in the United States. We have accepted Google’s Cloud Data Processing Addendum for Workspace, which includes international-transfer provisions. Processing locations and arrangements depend on the provider and the Services used.

Data-protection laws and available protections can differ between countries. Applicable transfer requirements depend on the information, Services, recipients and locations involved. For questions about the locations or transfer arrangements relevant to your information, contact team@hypercubic.ai.

Your applicable privacy rights and the request routes in this Notice continue to apply to information covered by those rights. You may contact team@hypercubic.ai to request information about relevant transfer safeguards where applicable.

9. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). Retention does not depend solely on whether you have an account with us. For business contact and prospect information, we consider the relevance of the information to the stated business purpose, the nature and recency of our interactions, whether there is an ongoing business relationship or relevant opportunity, and your expressed preferences. We do not retain information for a purpose after it is no longer necessary for that purpose.

We may retain limited information where necessary to record and honor an objection or opt-out, handle a privacy request or complaint, comply with a legal obligation, or establish, exercise, or defend legal claims. Information retained for these purposes is restricted to those purposes and retained only for as long as necessary. Retaining an opt-out record does not permit continued use of your information for direct marketing.

Retention periods can differ by record and system. To request deletion or ask about a particular record, contact team@hypercubic.ai. Legal, accounting and other applicable exceptions may limit deletion. Browser-cookie expiry or the validity of a tracking choice does not determine the retention of records held by us or our providers.

10. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

11. Do We Collect Information From Minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age or the equivalent age as specified by law in your jurisdiction.

We do not knowingly collect, solicit data from, or market to children under 18 years of age or the equivalent age as specified by law in your jurisdiction, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or the equivalent age as specified by law in your jurisdiction or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age or the equivalent age as specified by law in your jurisdiction has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18 or the equivalent age as specified by law in your jurisdiction, please contact us at team@hypercubic.ai.

12. What Are Your Privacy Rights?

In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. If a decision that produces legal or similarly significant effects is made solely by automated means, we will inform you, explain the main factors, and offer a simple way to request human review. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

We will consider and act upon any request in accordance with applicable data protection laws.

If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. For optional website tracking, you can change or withdraw your choice through Privacy choices, as described in Website cookies, tracking, and your choices. You can also withdraw your consent by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications: We do not currently send SMS messages, including marketing, transactional, or service messages. To object to direct marketing or request that marketing messages stop, contact team@hypercubic.ai. If a message provides an unsubscribe link, you can also use that link. We will handle your request in accordance with applicable law. Limited information may be retained to record and honor your preference as described in How Long Do We Keep Your Information?. Service-related communications may still be sent when necessary for an account, requested service, or other non-marketing purpose.

You do not need an account to make a privacy request or object to direct marketing. Website tracking choices and requests concerning existing contact records are separate: changing a browser choice does not by itself delete records already held by us or our providers.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account.
  • Contact us using the contact information provided.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. You may also opt out of interest-based advertising by advertisers on our Services.

If you have questions or comments about your privacy rights, you may email us at team@hypercubic.ai.

Privacy requests and complaints

You may contact us at team@hypercubic.ai to exercise applicable privacy rights or raise a complaint about our handling of your personal information, including information obtained from other sources. You do not need to have an account with us to do so.

We handle requests and complaints within the periods required by applicable law. We may request information reasonably necessary to verify your identity, authority, or the information to which a request relates. We apply any limitations, exceptions, fees, or extensions only where permitted by applicable law and provide the explanations and information about review or complaint rights that the law requires.

We take appropriate steps to investigate privacy complaints, keep you informed as required, and communicate the outcome without undue delay. You retain the right to complain to the relevant supervisory authority where applicable.

13. Controls For Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

The statements above concern DNT browser signals. Global Privacy Control is a separate opt-out preference signal. On this website, a detected Global Privacy Control signal keeps visitor identification and marketing off even if you choose Accept all.
